1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.

2. License to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement (EULA).

You may not:

Copy, modify, distribute, sell, or lease any part of the App;
Reverse engineer, decompile, or attempt to extract the source code, except where permitted by law;
Use the App in any unlawful way or to build a competing product;
Attempt to disrupt, overload, or gain unauthorized access to the App or its supporting infrastructure.

3. Your account

Some features require an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at support@deepskyapps.com if you suspect unauthorized use. You are responsible for the accuracy of the information you provide.

4. Subscriptions and payments

The App offers a free tier and optional auto-renewable subscriptions ("Premium") that unlock additional features.

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours before the end of the current period, at the rate disclosed at purchase.
You can manage or cancel your subscription in your Apple ID account settings after purchase.
Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.
Prices may vary by region and are shown in the App before purchase.

All purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple in accordance with its policies; we generally cannot issue refunds directly.

5. AI features

The App includes features powered by artificial intelligence (for example, task parsing, scheduling suggestions, and daily plans). You understand and agree that:

AI-generated output may be inaccurate, incomplete, or unsuitable, and you are responsible for reviewing it before relying on it.
AI output is provided for planning and productivity purposes only and is not professional advice of any kind.
The text you submit to AI features is processed by third-party AI providers as described in our Privacy Policy. Do not submit information you would not want processed by an external AI service.

6. Not medical or health advice

Simple is a productivity and focus tool. It is not a medical device and does not provide medical, psychological, diagnostic, or therapeutic advice. Any content referring to ADHD, focus, wellbeing, or routines is for general informational and organizational purposes only and is not a substitute for professional advice, diagnosis, or treatment. Always seek the guidance of a qualified health provider with any questions about a medical or mental-health condition. Never disregard or delay professional advice because of something you read or received in the App.

7. Your content

You retain ownership of the tasks, activities, notes, and other content you create in the App ("Your Content"). By submitting content to shared features (such as feature requests or comments), you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content for the purpose of operating and improving the App. You are responsible for Your Content and confirm you have the rights to submit it.

You agree not to submit content that is unlawful, infringing, harmful, harassing, or otherwise objectionable. We may remove content that violates these Terms.

8. Intellectual property

The App, including its design, code, branding, text, and graphics (excluding Your Content), is owned by the developer and protected by intellectual property laws. Except for the license granted in Section 2, no rights are transferred to you. "Simple" and associated logos are marks of the developer. Third-party names and marks (such as Apple) belong to their respective owners.

9. Third-party services

The App relies on third-party services (including Apple, Google/Firebase, RevenueCat, AIProxy, and OpenAI). Your use of those services through the App may also be subject to their terms and policies. We are not responsible for the acts or omissions of third-party providers.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DATA WILL ALWAYS BE PRESERVED. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF IMPORTANT INFORMATION.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR, IF YOU PAID NOTHING, £50 (OR THE EQUIVALENT IN YOUR CURRENCY).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

12. Termination

You may stop using the App at any time and delete your account from within the App or by contacting us. We may suspend or terminate your access if you breach these Terms or use the App in a way that could harm us, other users, or third parties. Sections that by their nature should survive termination (including Sections 6 to 11) will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law in your country of residence provides otherwise.

15. Apple-specific terms

These Terms are between you and the developer, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
